Serious damage to property or injury to a person

The owner or tenant may apply to the Magistrates Court for an Order of termination if the other party causes or is likely to cause:

  • serious damage to the property or its contents, or to a neighbouring property, or
  • physical injury to someone living at the property or to someone from a neighbouring property.

An Order of termination ends the lease on the date ordered by the Court.

Family violence

If a court makes a Family Violence Order against a tenant, the court may make an order ending their lease. The court may also make a new lease for the benefit of the person affected by the violence or the person against whom the Family Violence Order is made.
